Contractual Disputes

An employment contract can often be the single most important document in assisting towards the resolution of employment disputes. It is imperative that you understand the nature and legal implications of the terms and conditions within your employment contract and ensure that you have adequate protection and cover against events that may cause your rights to be called in to question.

Discrimination

All employees are legally protected against discrimination stemming from their employers who must in turn take every provision to prevent discrimination from any other employees.

Unfair Dismissal

The Employment Rights Act 1996 will only allow employers to consider dismissal on the grounds of an employees conduct, capability, company redundancy, the non-renewal of a fixed-term contract or retirement. The grounds must be justifiable and the procedure to effect them must be fair. Whilst these types of dismissal are instigated by an employer the tribunal recognises a separate form of 'constructive dismissal' which can be brought by an employee if they have been made to retire as a direct result of their employers’ conduct towards them.

Redundancy

It is not uncommon for people to suddenly find that after years of climbing the corporate ladder it suddenly gets pulled from under them. Redundancy is often disorientating and stressful.
